Consent & Capacity Addendum

Effective date: [DATE]

Why this addendum exists

Logos is sometimes used to support a person living with cognitive decline (the "Primary User"). That person's dignity, autonomy, and rights come first. This addendum explains how consent works so that Logos supports the person without becoming a tool of surveillance or control.

Guiding principles

  1. Assume capacity. A diagnosis does not remove a person's right to make their own decisions. Early-stage users can and should consent for themselves wherever possible.
  2. Support, don't replace, decision-making. Logos is designed as cognitive scaffolding — to help the person do things themselves.
  3. Least restrictive option. Monitoring features (especially location) should be the minimum necessary, and always visible to the person.
  4. Consent is ongoing, not one-off. It should be revisited as circumstances change.

Consent by the Primary User

Where the Primary User has capacity, they consent for themselves to: - use of the App and its companion features; - saving of voice recordings and life-story content; - any location / Safe Zone feature, which is off by default and requires their explicit, informed agreement.

The Primary User can withdraw any consent at any time, and can hide or delete their own content.

Where a person may lack capacity for a specific decision

If the Primary User cannot consent to a specific feature at a specific time, that decision should be made by a person with legal authority to act for them — for example, an attorney under a Lasting Power of Attorney (health & welfare), a court-appointed deputy, or the equivalent in your jurisdiction — and only in the person's best interests. You must confirm you hold such authority when enabling features on another adult's behalf.

Logos is not a substitute for legal authority. Enabling monitoring of another adult without their consent or proper legal authority may be unlawful.

Location and monitoring — special safeguards

Protecting against misuse

Logos prohibits use of the App to coerce, isolate, or surveil a person against their interests. If we become aware of such misuse, we may restrict or terminate access. Concerns can be reported to [safeguarding@logos.app].

Acknowledgement

By enabling companion, location, or monitoring features, you confirm that you either are the Primary User consenting for yourself, or you have the legal authority and best-interests basis to act on their behalf.
